Is THC legal in Wisconsin? Hemp products, the September 2026 vape directory, and what is still unregulated
As of September 17, 2026 Wisconsin regulates only hemp vapes: since July 2, 2026 a hemp vape that is not listed in the Department of Revenue directory may not be sold, and since September 1, 2026 a forfeiture of $1,000 a day for each device applies (Wis. Stat. 995.15; both days are from the Department's Common Questions page, read October 8, 2026; under s. 995.15(2m) the manufacturer's certification under sub. (2) first applies to a hemp vape on July 1, 2026). For hemp-derived gummies and drinks, Wis. Stat. s. 94.55 (read October 8, 2026) sets no cap, seller licence or age limit; THCA flower and delta-8 are not confirmed.

Converted delta-8 leaves the federal hemp definition on December 11, 2026 — not November 12. Why: P.L. 119-103 §2019 keeps the change for cannabinoids 'synthesized or manufactured outside the plant' until Dec 11. State bans apply sooner in Texas and elsewhere.

Is THC legal in Georgia? Hemp gummies, drinks, THCA and delta-8 under SB 494
As of October 8, 2026: Georgia allows licensed sales of hemp delta-9 and delta-8 products to adults 21+ with caps of 10 mg per gummy serving and 10 mg per 12 oz drink; flower and THC-infused foods are banned. THCA flower is not sold as hemp.

Is THC legal in North Carolina, and what would HB 328 change?
As of October 8, 2026: N.C.G.S. 90-87 excludes hemp products from its marijuana definition and sets no licence, age limit or cap; converted delta-8 and lab-made cannabinoids are not confirmed. HB 328 — a 0.4 mg per container cap and 21+ — passed the Senate 37-6 and awaits a House vote. If adopted, its cap takes effect November 12, 2026.

As of October 8, 2026, Texas has not banned hemp delta-9 THC: edibles and drinks at 0.3% or less total delta-9 THC are legal for adults 21+ at DSHS-registered retailers. A DSHS notice published July 10, 2026 put other THCs back in Schedule I; THCA flower over 0.3% total delta-9 THC fails the test; cannabinoid vape sales are banned. Is THC legal in Florida? Hemp delta-9, THCA, delta-8, drinks and vapes
As of October 8, 2026: hemp delta-9 edibles, drinks and vapes are legal in Florida for adults 21+ from permitted hemp food establishments; the status of delta-8 is not confirmed; high-THCA flower fails the total-THC limit (rule 5K-4.034, upheld on appeal February 10, 2026). Fla. Stat. 581.217 and R. 5K-4.034 (read October 8, 2026) set no mg cap; the federal 0.4 mg cap arrives December 11.

Is THCA legal in Tennessee? The 2026 total-THC rule, the ABC channel and the 15 mg cap
As of October 8, 2026: Tennessee counts THCA toward total THC (Public Chapter 526), so THCA flower is not a hemp product; other hemp-derived cannabinoid products sell only through ABC-licensed retailers, to buyers 21 and over, since July 1, 2026, with 15 mg per serving. No shipping or delivery.

Ohio hemp ban: what SB 56 does and what the injunctions mean
Since March 20, 2026 Ohio treats hemp products over 0.4 mg THC per container, and any with synthetic cannabinoids, as marijuana — sold only through licensed dispensaries (R.C. 928.01). A federal judge enjoined enforcement for named plaintiffs on September 4, 2026; a Sixth Circuit appeal is pending.

THC ban 2026? What changes federally on Nov 12 and Dec 11, 2026
The federal hemp change (P.L. 119-37 §781) is not a single 'THC ban': two dates in 2026 change what counts as hemp. Two federal dates, widely confused. Nov 12, 2026: only products with cannabinoids the plant cannot make (THC-O and the like) leave the hemp definition. Dec 11, 2026: total THC including THCA must be 0.3% or less, final products are capped at 0.4 mg THC per container, and converted delta-8 is excluded. Dec 11 may move with the federal funding bill.
