Is THC legal in Wisconsin? Hemp products, the September 2026 vape directory, and what is still unregulated

Short answer, as of September 17, 2026: Wisconsin regulates one class of hemp product — vapes. Since July 2, 2026 a hemp vaping device that is not listed in the Department of Revenue's directory may not be sold or offered for sale (Wis. Stat. 995.15, as amended by 2025 Act 129); since September 1, 2026 a forfeiture of $1,000 a day for each device applies. Both days are from the Department's Common Questions page (read October 8, 2026), which says 'beginning July 2, 2026'. The statute's own day is July 1, 2026, and it is the day when the manufacturer's certification under sub. (2) first applies to a hemp device: under s. 995.15(2m) (read October 9, 2026) 'The requirements of sub. (2) first apply to a manufacturer of an electronic vaping device that meets the description provided under sub. (2) (c) on July 1, 2026' (sub. (2) (c) is a device that 'contains hemp, as defined in s. 94.55 (1), and does not contain nicotine'). For the sale rule the Department's directory page (read October 9, 2026) says 'beginning July 1, 2026'. For hemp-derived gummies and drinks, Wis. Stat. s. 94.55 (read October 8, 2026) sets no cap, seller licence or age limit. THCA flower and delta-8 are not confirmed (see the table).

Wisconsin is one of the states where the federal dates are the only scheduled change: cannabinoids the plant cannot make leave the hemp definition on November 12, 2026; total THC including THCA, the 0.4 mg per container cap and converted delta-8 on December 11, 2026. The countdown tracks both and the funding bill that could move the second date.

Not confirmed. Wis. Stat. s. 94.55(1) measures delta-9 THC 'as tested using post-decarboxylation or other similarly reliable methods', and decarboxylation turns THCA into delta-9 THC; the Legislative Council's brief says state law continues 'to focus solely on delta-9 THC concentration rather than on total THC'. Federally THCA counts from December 11, 2026.
›Are THC drinks legal in Wisconsin?
Wis. Stat. s. 94.55 (read October 8, 2026) has no drink rule; under s. 94.55(2)(a) a person may "sell ... hemp in this state to the greatest extent allowed under federal law". The federal 0.4 mg per container cap applies from December 11, 2026.
