Ohio hemp ban: what SB 56 does and what the injunctions mean

Short answer, as of October 8, 2026: since March 20, 2026 Ohio's SB 56 (R.C. 928.01) treats hemp products over 0.4 mg THC per container, and any product with synthetic cannabinoids, as marijuana — lawful only through licensed dispensaries at 21+. Ohio's cap matches the federal cap that arrives December 11, 2026, nine months early.
The litigation
- September 4, 2026 — Judge Helmick in the Northern District of Ohio granted a preliminary injunction in Delta Beverages Inc. v. Canepa (3:26-cv-01793). It protects the named plaintiffs; it does not suspend the law for everyone.
- Titan Logistics v. Tischler is on appeal at the Sixth Circuit (No. 26-3648). The court stayed the July 13 injunction pending appeal, except as to the in-state sourcing restriction (Ohio Adm. Code 3796:6-3-01(C)).
