Short answer, as of October 8, 2026: Georgia allows licensed sales of hemp-derived delta-9 and delta-8 products to adults 21+, with caps of 10 mg per gummy serving and 10 mg per 12-ounce drink. Hemp flower, pre-rolls and THC-infused foods are banned as consumable hemp, so THCA flower is not a lawful retail product. The rules date from SB 494 (2024) and the Department of Agriculture's January 2025 caps; a search of SB 33 of the 2026 session (the 'as passed' text) on October 8, 2026 found no mention of hemp.

Retailers need a consumable hemp retail licence from the Department of Agriculture, which publishes the licensing page; that page (read October 8, 2026) does not have the words 'roster', 'directory' or 'lookup'; seller profiles for Georgia come from claims.

Federal dates

Georgia's caps sit above the federal 0.4 mg per container limit that applies from December 11, 2026 (P.L. 119-37 §781 as delayed by P.L. 119-103 §2019).
