Short answer, as of October 8, 2026: under federal law, delta-8 THC made from CBD (the way nearly all commercial delta-8 is made) leaves the hemp definition on December 11, 2026, not November 12.

What delta-8 is

Delta-8 THC is a tetrahydrocannabinol (THC), like the delta-9 THC that the hemp limit names. Federal law does not sort it by its effect but by where it was made. The new hemp definition excludes cannabinoids that "are capable of being naturally produced by a Cannabis sativa L. plant" and "were synthesized or manufactured outside the plant" (P.L. 119-37 §781). Delta-8 made from CBD outside the plant falls in that exclusion — from December 11, 2026 (P.L. 119-103 §2019).

The statute, in plain words

P.L. 119-37 §781 lists what hemp does not include. Two of the exclusions matter here:

  • (I) cannabinoids that are not capable of being naturally produced by the plant — THC-O, for example;
  • (II) cannabinoids that the plant can produce but that were synthesized or manufactured outside the plant — converted delta-8 and delta-10.

P.L. 119-103 §2019 (signed September 2, 2026) says that until December 11, 2026 the new definition applies only to products described in subclause (I). Delta-8 is a cannabinoid the plant can produce, so it sits in (II) and changes on December 11. On October 8, 2026 we found no FDA list that formally assigns each cannabinoid, on FDA's cannabis page or in a Federal Register search for FDA documents (a dated search, not a confirmation), and the December date may move with the federal funding bill — see the countdown.

DEA disagrees about the time before that. In its HHC rule, effective May 4, 2026 (91 FR 23913), DEA says 'tetrahydrocannabinols produced through chemical conversion, even when hemp derived are considered synthetically produced for purposes of the CSA' and do not qualify as hemp. So federal status before December 11 is disputed. Ask a lawyer before you sell.

What "leaves the hemp definition" means

A product that is no longer hemp is marijuana or THC under the Controlled Substances Act for general retail purposes (the 2026 rescheduling order moved only FDA-approved drugs and state-licensed medical marijuana to Schedule III). This site shows legality information only; it never links to sales of a class that is federally controlled on the viewing date.

State law comes first

Federal timing does not help a seller in a state that already acts: Texas covers delta-8 products in Schedule I (DSHS notice, published July 10, 2026); Alabama, California, Hawaii and others ban converted cannabinoids; Tennessee routes hemp-derived delta-8 through its licensed channel; in Florida its status is not confirmed.
