Short answer, as of October 8, 2026: yes, with conditions. Hemp-derived delta-9 THC products that contain 0.3% or less delta-9 THC by dry weight — gummies, other edibles and drinks — are legal in Texas for adults 21+, sold by businesses registered with the Department of State Health Services. Drinks sold in bars and stores also follow the Alcoholic Beverage Commission's rules.

The conditions

  • 0.3% by dry weight. Texas measures total delta-9 THC (delta-9 plus 0.877 × THCA). For a gummy or a drink the THCA share is normally zero, so the delta-9 line on the certificate of analysis is what counts.
  • 21+. A TABC licensee or permittee may not sell to a person under 21 (16 TAC §§35.5 and 35.6, in force since January 21, 2026; emergency rules before that, adopted September 23, 2025). DSHS adopted emergency rules with the same age limit for its licensees and registrants on October 2, 2025, and 25 TAC ch. 300 is in force since March 31, 2026.
  • Registered sellers. Retailers register, manufacturers and distributors are licensed; DSHS publishes the list.
  • 25 TAC ch. 300 as adopted (read October 8, 2026) sets no milligram cap. Products are limited by the dry-weight percentage, not by mg per serving.

What is not covered by "delta-9 is legal"

  • Delta-8, delta-10 and other converted cannabinoids are Schedule I in Texas under a DSHS notice published July 10, 2026.
  • THCA flower fails the total-THC test — see Is THCA flower still legal in Texas?.
  • Vapes containing any cannabinoid may not be sold (SB 2024, effective September 1, 2025).

Federally, final hemp products are capped at 0.4 mg total THC per container from December 11, 2026 (P.L. 119-37 §781, delayed by P.L. 119-103 §2019). A 10 mg gummy or a 5 mg seltzer is far above that cap, so most delta-9 edibles and drinks sold in Texas today leave the federal hemp definition on that date unless Congress moves it again.
