Is THCA legal in Tennessee? The 2026 total-THC rule, the ABC channel and the 15 mg cap

Short answer, as of October 8, 2026: THCA flower is not a hemp product in Tennessee. Public Chapter 526 (2025) redefined hemp to exclude products over 0.3% total THC including THCA, effective January 1, 2026. Other hemp-derived cannabinoid products — gummies, drinks, tinctures, and hemp-derived delta-8 — are sold only through Alcoholic Beverage Commission-licensed retailers, to buyers 21 and over, since July 1, 2026, with a cap of 15 mg THC per serving (20 servings or 300 mg per package; drinks 2 servings and 750 ml). No shipping or delivery.
The framework
- January 1, 2026 — ABC oversight begins; the total-THC definition applies.
- April 2026 — Public Chapter 698 amended the rules (effective on becoming law).
- June 9, 2026 — ABC rules chapter 0100-16 took effect (filed March 11, 2026).
- July 1, 2026 — every seller must be licensed; sales limited to licensed retail premises, package stores and bars.
The enacted text sets 15 mg per serving, not 25.
