- HHC is federally Schedule I by name since May 4, 2026 (91 FR 23913). Ask a lawyer before you sell. HHC and THCP are on the CHFS adult-use list (21+, registered products, permitted retailers). THC-O is not on the list (902 KAR 45:021, read Oct 8, 2026), and 902 KAR 45:021 says all other cannabinoids 'are prohibited for sale in Kentucky unless pre-approved' by the cabinet, so THC-O appears barred unless pre-approved (not yet confirmed by CHFS). The state allowance does not change federal scheduling. May ship to buyers over 21 in packages marked 'Adult-use only'; out-of-state shippers must be registered (902 KAR 45:012 §2(5)-(6)).

A search of the Sep and Oct 2026 Administrative Registers on Oct 8, 2026 found no amendment to 902 KAR 45:001, 45:012 or 45:021.

Federal: cannabinoids the plant cannot make leave the hemp definition
From Nov 12, 2026, products containing cannabinoids that are not capable of being naturally produced by the plant (for example THC-O) are no longer hemp under P.L. 119-37 §781 as limited by P.L. 119-103 §2019. Everything else waits until Dec 11, 2026. On Oct 8, 2026 we found no FDA list that names the cannabinoids, on FDA's cannabis page or in a Federal Register search for FDA documents (a dated search, not a confirmation).
