Licensed channel only

In short
Hemp means 0.3% or less total THC including THCA and final products at 0.4 mg or less combined total THC per container; anything above is marijuana, sold only in DCC-licensed adult-use dispensaries (21+). A federal PI still exempts the named Delta Beverages plaintiffs' federally defined hemp products (State appeal filed Oct 5, 2026; later docket entries not yet confirmed); the Titan and Fresh Farms plaintiffs are now protected only against the in-state sourcing restriction.

Titan Logistics v. Tischler, 6th Cir. No. 26-3648: the Sixth Circuit granted Ohio's motion for a stay pending appeal in part; the Jul 13, 2026 PI 'remains in effect as to the named Plaintiffs only, and only insofar as it prohibits enforcement of' the geographic sourcing restriction in Ohio Adm. Code 3796:6-3-01(C) or any other requirement that conditions market participation on in-state cultivation or processing; 'The injunction is stayed in all other respects pending appeal.' (the Sixth Circuit docket, read Oct 8, 2026, shows a judge order filed on Sep 25, 2026; that this is the stay order is not confirmed). Delta Beverages Inc. v. Canepa, 3:26-cv-01793 (N.D. Ohio): the Sep 4, 2026 PI bars enforcing SB 56's hemp definition against the named plaintiffs' federally defined hemp products; the State filed a notice of appeal on Oct 5, 2026 and the court denied its motion to modify the PI without prejudice for lack of jurisdiction; the contents of a 'Stay' entry (Oct 6) and an 'Order' (Oct 7) are not yet confirmed. Fresh Farms E Liquid LLC v. Tischler, 3:26-cv-02059 (N.D. Ohio): PI Sep 24, 2026, narrowed on Oct 5, 2026 to the geographic-sourcing restriction only. SB 56 is otherwise in force.

Federal overlay · applies from Dec 11, 2026

Federal: total THC (incl. THCA) ≤0.3%, 0.4 mg per container, converted delta-8

From Dec 11, 2026, hemp means total THC including THCA at 0.3% or less by dry weight; final products are capped at 0.4 mg total THC per container; cannabinoids made outside the plant (converted delta-8, delta-10) are excluded. Scheduled — Dec 11 is also the day the federal funding bill expires, and the White House budget office asked Congress in June for 'at minimum, an extension'. Watch the countdown.

Frequently asked questions

›Does 'not yet verified' mean banned?

No. A grey lamp means we have not checked that state and product class against a primary source yet. It is on the verification queue. Verified rows show the statute and the day we checked.

›Does the checker decide whether my product is legal?

No. It shows the state row for a product class: the lamp, the channel, the caps and the statute. Compare your label or certificate of analysis with the caps yourself. The status lamp comes from the rules row only.

›What is a 'licensed channel only' lamp?

The product class may be sold in that state, but only through a licensed channel — a licensed hemp retailer, a liquor or package store, or a marijuana dispensary — often with caps and an age limit. The row names the channel and the statute.
