NM hemp facilities may not receive, make, market or sell semi-synthetic or synthetic cannabinoids (emergency rule Aug 1, 2025; final Jan 28, 2026), with exceptions for 98%-pure THCV, CBC, CBT, CBL, CBE, CBG, CBDV, CBD and CBN. The rule (20.10.2 NMAC, read Oct 8, 2026) gives its scope as "the transportation, extraction, storage, or processing of hemp products in New Mexico"; it does not say whether it reaches a retailer that only resells products made elsewhere. So the retail lamp is not confirmed.

From Dec 11, 2026, hemp means total THC including THCA at 0.3% or less by dry weight; final products are capped at 0.4 mg total THC per container; cannabinoids made outside the plant (converted delta-8, delta-10) are excluded. Scheduled — Dec 11 is also the day the federal funding bill expires, and the White House budget office asked Congress in June for 'at minimum, an extension'. Watch the countdown.
